Selling Your Home After August 1st? You Could Lose the Sale if You Don’t Know THIS

If you’re planning to sell your property in Queensland anytime soon — STOP and read this first.

From 1 August 2025, new laws are coming into effect that could cost you your sale (or worse — open you up to legal trouble) if you’re not prepared.

Under Queensland’s Property Law Act 2023, every seller will be legally required to disclose key information about their property before a buyer signs the contract. And if you miss something important, the buyer could walk away right before settlement — no questions asked.

Here’s what you need to know to stay out of trouble.


🔍 What You MUST Disclose (or Risk Losing the Deal)

Before a buyer signs the contract, you’ll need to hand over a full disclosure statement that includes:

  • A title search and registered plan
  • Any easements, unregistered encumbrances, or zoning issues
  • Council notices or proposals
  • Pool safety certificates
  • Any building approvals for renovations, pools, decks, extensions — even if they’re old
  • Whether the property has unapproved structures (yes, that DIY patio matters)

Even if your property is going to auction, this disclosure must still be provided in advance. The rules apply across the board.


😬 What If There’s a Mistake in the Disclosure?

If you forget to include something important — or there’s a factual error in the documents — your buyer might be legally allowed to:

  • Pull out of the deal at any point before settlement
  • Or, in serious cases, take legal action if they’ve suffered a loss

This includes missing DA approvals, inaccurate zoning info, or failing to disclose unapproved building works.


🛠️ Renovated? Added a Pool? You Need to Declare It

If you’ve made any structural changes — even years ago — you’ll need to confirm they’re approved. And if they’re not approved, you still need to let the buyer know.

Being honest won’t kill the deal. Hiding it might.
